Cookies policy

In compliance with the legal duty to provide information established in Article 13 of Regulation (EU) 2016/679 and Article 11 of the LOPD 3/2018, the following information is provided INFORMATION concerning the personal data which are the subject of the processing, we inform you of the following:

 

DATA CONTROLLER: For your information, and to the effects legally prevented, we inform you that this insurance broker/brokerage:

 

  • He/she complies with all the requirements established by law, being registered in the Special Administrative Register of Insurance Mediators, Reinsurance Brokers and their Senior Officers under code number J3335You can check it on the website of the Directorate General for Insurance and Pension Funds. www.dgsfp.mineco.es 

 

  • It has taken out a Professional Civil Liability policy and has the legally established financial capacity, all in compliance with the provisions of art. 27.1, sections e) and f), in relation to Transitional Provision 3 of Law 26/2006, respectively.

Purposes

  1. Applicants or contacts who fill in a contact or quote request web form, and tick the corresponding box, expressly consent and authorise their personal data to be collected and processed for the purpose of maintaining the mediation and professional advice relationship for the coverage of the risks to be insured, including the corresponding profile analysis, as well as to manage the contracting of insurance policies and the monitoring of their execution, compliance and incidents that may occur, and financial advice, including the profile analysis. Your personal data will be communicated to insurance companies to the extent necessary to provide the requested service, as well as to underwriting agencies or other brokerages on a case-by-case basis.

  2. In the case of sending forms, data collection will include the IP address of the computer from which the form is sent. Also, only if strictly necessary, health data will be included.

  3. If you consent by ticking the corresponding box, your personal data will also be used to send you information and publicity, by any means (e-mail, sms, fax, letter, etc.) about products related to the insurance and financial activity that we consider to be of interest to you.

Personal data shall be retained for the statutory limitation periods (five years from the termination of the customer's membership in general or ten years from the execution of the life or investment proposal). They will only be communicated to third parties for legal compliance or with the authorisation of the interested party.

This does not prevent the possibility of processing authorised by you in the event of new contracts, or processing for advertising purposes, and this information will be retained until you exercise your right of deletion or opposition and subsequently during the legal periods of complaint.

On the basis of the information provided, analyses of your personal profile are carried out in order to provide you with effective advice. The data provided to the Companies or entities may be processed by them in order to make automated decisions, based on their risk analysis statistics. In such a case, these decisions would be permitted by law, as they are necessary for the conclusion of a contract with the company or entity.

The WEB user www.acges.com  shall be solely responsible for the truthfulness and accuracy of the data provided, with ACG MEDIACION S.L. acting in good faith as a mere service provider. In the event of having provided false data or data of third parties without their consent, ACG MEDIACION S.L. reserves the right to immediately destroy the aforementioned data in order to protect the rights of the owner or owners of the same.

LEGITIMACYLaw 26/2006, on Private Insurance and Reinsurance Mediation, or any regulation that may replace it in the future, authorises the Broker to process the data of the persons addressed to them, without the need for their consent:

  • Before concluding the contract: for orThe insurance or reinsurance undertaking with which the relevant contract is to be concluded shall provide them with independent, professional and impartial advice, and shall provide such information to the insurance or reinsurance undertaking with which the relevant contract is to be concluded. 
  • After the contract has been concluded, to provide the policyholder, the insured and the beneficiary of the insurance with the information they require on any of the clauses of the policy and, in the event of a claim, to provide them with assistance and advice.

All other purposes have a legitimate basis in your consent, both those inherent to the contract you sign with this brokerage and the policy/s that may be formalised. Likewise, your consent is the basis for the publicity processing that you authorise, without the withdrawal of this consent under any circumstances being a condition for the execution of the brokerage contract.

Addressees

Personal data will only be disclosed to third parties in order to comply with legal obligations, e.g. to the tax authorities, or to insurance companies, underwriting agencies or other brokers to the extent necessary for insurance quotations, policy underwriting or policy execution. Likewise, in those cases where the regulations so determine, they shall be communicated to the Ministry of Justice as the body in charge of the Register of Insurance Contracts.

In the event that quotations are requested or policies are taken out with foreign insurance entities outside the European Economic Area, international transfers of data will be covered by the European Data Protection Regulation or, where applicable, the EU-US Privacy Shield Agreement.

Security measures

ACG MEDIACION S.L. undertakes to comply with its obligation of secrecy of personal data and its duty to protect them and will adopt all technical and organisational measures to guarantee the security of personal data and avoid its alteration, loss, unauthorised processing or access, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed.

The ACG MEDIACION S.L. website uses cookies. 

The website has information security measures in place, generally used for example: firewalls, access control procedures and cryptographic mechanisms, in order to prevent unauthorised access to the data provided.

Rights

Any person has the right to revoke their initial consent, to request access to personal data concerning them, to request their rectification or erasure, to request the limitation of their processing, to object to their processing (if there is public interest or legitimate interest) and/or the right of portability. In all cases, you may exercise your rights by e-mail addressed to info@acges.comaccompanied by an identity document. Any person may lodge a complaint with the Spanish Data Protection Agency, the forms being available at www.agpd.es if they consider that their rights have not been satisfied.

For the purposes of advertising processing authorised by your consent, you have the right to withdraw your consent at any time, without this affecting the lawfulness of the processing based on the consent prior to the withdrawal.
